Welcome to the National Nutrition and Wellness Academy (NNWA). These Terms and Conditions (“Terms”) govern your use of our website (the “Site”), our Learning Management System (LMS), mobile applications, and your enrollment in our Diploma, Certification, and Personal Training programs (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services or enroll in our courses.


1. GENERAL PROVISIONS

1.1. Ownership: The Site and Services are owned and operated by National Nutrition and Wellness Academy (NNWA). (hereinafter referred to as “NNWA”, “we”, “us”, or “our”), a company incorporated under the laws of India, with its registered office at Kolkata, West Bengal.

1.2. Eligibility: To use our Services, you must be at least 18 years old or have the consent of a parent/legal guardian. By enrolling, you represent that all registration information you submit is truthful and accurate.

1.3. Modifications: NNWA reserves the right to change these Terms at any time. Continued use of the Services following any changes signifies your acceptance of the new Terms.


2. ACADEMIC & CERTIFICATION POLICIES

2.1. OFFICIAL CERTIFICATION POLICY AND DISCLAIMER

I. Professional Qualification Limitation

The Certificate of Completion awarded by the National Nutrition and Wellness Academy (NNWA) upon successful fulfillment of all program requirements does not constitute, nor is it intended to confer, professional licensure or qualification for practice as a Dietitian or Registered Dietitian under any local, state, or national jurisdiction.

This certification is designed solely to provide in-depth knowledge and advanced professional development within the nutrition and wellness field. The NNWA’s curriculum serves as a continuing education and knowledge-building program and is not intended to supplant, replace, or satisfy the formal educational, supervised practice, or credentialing requirements mandated for obtaining protected professional status as a Dietitian.

II. Mandatory Evaluation and Certification Eligibility

Payment of the prescribed course fee grants the participant access to the NNWA curriculum and learning resources. However, payment alone does not guarantee the issuance of the Certificate of Completion.

The Certificate of Completion is a formal acknowledgment of demonstrated competency and is exclusively conferred upon participants who successfully meet all mandatory evaluation criteria. Participants must:

  • Fulfill 100% of all stated attendance and participation requirements.

  • Satisfactorily complete and submit all required course assignments, projects, and assessments.

  • Achieve a minimum cumulative passing score (as stipulated in the course guidelines) across all mandatory examinations and evaluative criteria set forth by the NNWA.

Failure to meet these mandatory evaluation criteria will result in the participant being ineligible to receive the official NNWA Certificate of Completion, irrespective of course fee payment.

3. PAYMENT, REFUNDS, AND EMI TERMS

3.1. Course Fees: All fees must be paid in full prior to the commencement of the course, or via an approved EMI plan. Prices are subject to change but will not affect users who have already enrolled.

3.2. EMI & Third-Party Lenders:

NNWA facilitates EMI options via third-party Non-Banking Financial Companies (NBFCs).

  • Liability: Any dispute regarding EMI deductions, interest rates, or loan rejection is strictly between the student and the NBFC. NNWA is not a party to the loan agreement.

  • Default: In the event of non-payment of EMI to the lender, NNWA reserves the right to suspend your access to the LMS and withhold certification until dues are cleared.

3.3. Refund Policy:

Due to the digital nature of our content and immediate access to proprietary materials:

  • No Refunds: Course fees once paid are non-refundable and non-transferable under any circumstances, including but not limited to medical emergencies, change of mind, or inability to cope with the curriculum.

  • Double Payment: In case of accidental double payment, a refund will be processed within 7-10 working days upon verification.


4. INTELLECTUAL PROPERTY & USAGE RIGHTS

4.1. License to Access: NNWA grants you a limited, non-exclusive, non-transferable license to access and view the course content for which you have paid, solely for your personal, non-commercial, educational purposes.

4.2. Proprietary Content: All materials, including but not limited to videos, gamified learning modules, PDFs, quizzes, and the “Program Kit” are the exclusive property of NNWA.

  • Prohibition: You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course content unless we give you explicit permission to do so in writing.

4.3. Anti-Piracy Measures:

  • Account Sharing: Your login credentials are for your personal use only. Sharing your login with others is strictly prohibited.

  • Monitoring: Our system monitors for concurrent logins and suspicious download activity. Detection of such activity will result in immediate termination of your account without refund and potential legal action for copyright infringement.


5. DISCLAIMERS & LIMITATION OF LIABILITY

5.1. Health & Medical Disclaimer:

The content provided in our Nutrition and Fitness courses is for educational purposes only.

  • Not Medical Advice: NNWA faculty and materials do not provide medical advice, diagnosis, or treatment.

  • Student Responsibility: You agree that any dietary or fitness advice you provide to future clients based on this certification is done at your own risk and discretion. You must adhere to the scope of practice and refer clients with medical conditions to qualified doctors.

5.2. Physical Safety Waiver (Online Training):

For courses involving physical activity (e.g., Personal Training Diploma):

  • Assumption of Risk: You acknowledge that remote training involves inherent risks. You assume full responsibility for any physical injury sustained during practice sessions at your home or gym. NNWA is not liable for injuries resulting from the execution of exercises demonstrated in our videos.

5.3. Job/Placement Disclaimer:

While NNWA offers “100% Placement Support”:

  • No Guarantee: We do not guarantee employment, a specific salary, or a job in a specific location. Placement depends on your performance, interview skills, and market demand.

  • Role of NNWA: Our role is limited to providing interview opportunities, resume guidance, and alumni networking.


6. STUDENT CODE OF CONDUCT

To maintain a professional learning environment, you agree NOT to:

  • Harass, abuse, or threaten faculty, staff, or other students in live classes or community portals.

  • Post promotional content or spam in the Alumni Community or student groups.

  • Engage in academic dishonesty, including cheating on exams or submitting work that is not your own.

  • Consequence: Violation of this code may result in immediate expulsion from the academy without a refund.


7. TECHNOLOGY & SYSTEM REQUIREMENTS

7.1. Hardware/Software: It is your responsibility to ensure you have a compatible device (Laptop/Smartphone) and a stable internet connection to access our visually engaging and gamified content.

7.2. Downtime: While we strive for 24×7 availability, NNWA is not liable for temporary system downtime due to maintenance or technical issues beyond our control.


8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.

8.2. Dispute Resolution: Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
